Public domain
This file is now in the public domain in the Republic of Korea (South Korea) because its term of copyright has expired there. (details)

According to Articles 39 to 44 of the Copyright Act of the Republic of Korea, under the jurisdiction of the Government of the Republic of Korea all copyrighted works enter the public domain 70 years after the death of the creator (there being multiple creators, the creator who dies last) or 70 years after publication when made public in the name of an organization. (30 years for death before 1957, 50 years before July 2013)

This applies to copyrighted works of which authors died before 1 January 1963, or made public in the name of an organization before 1 January 1963.

Furthermore, with the exceptions of photographs reproducing otherwise copyrighted works of art, and photographs inserted into a work of study or art and produced only for the purpose of inclusion within said work, photographs or other works of a similar form to photography either published or produced in negative on or before 31 December 1976 are now in the public domain in the Republic of Korea as their term of copyright has expired there.

There are exceptional cases. Property rights are to belong to the state according to provisions of the Civil Law and other laws upon the death of a copyright owner without heir or, in the case of a legal person or organization, upon its dissolution. The product must also be in the public domain in the United States.

You must also include a United States public domain tag to indicate why this work is in the public domain in the United States. Note that a few countries have copyright terms longer than 70 years: Mexico has 100 years, Jamaica has 95 years, Colombia has 80 years, and Guatemala and Samoa have 75 years. This image may not be in the public domain in these countries, which moreover do not implement the rule of the shorter term. Honduras has a general copyright term of 75 years, but it does implement the rule of the shorter term. Copyright may extend on works created by French who died for France in World War II (more information), Russians who served in the Eastern Front of World War II (known as the Great Patriotic War in Russia) and posthumously rehabilitated victims of Soviet repressions (more information).

Public domain
This work is in the public domain in the United States because it was published (or registered with the U.S. Copyright Office) before January 1, 1929.

Public domain works must be out of copyright in both the United States and in the source country of the work in order to be hosted on the Commons. If the work is not a U.S. work, the file must have an additional copyright tag indicating the copyright status in the source country.
Note: This tag should not be used for sound recordings.PD-1923Public domain in the United States//commons.wikimedia.org/wiki/File:Yun_Sim-Deok_-_In_Praise_of_Death.ogg
This sound recording was first fixed prior to February 15, 1972. Under Title II (Classics Protection and Access) of the Orrin G. Hatch–Bob Goodlatte Music Modernization Act, which was signed into law on October 11, 2018, sound recordings that were first fixed prior to February 15, 1972 are protected from unauthorized use in the United States as follows:
  • Recordings that were first published prior to 1924 are in the public domain.
  • Recordings that were first published between 1924 and 1946 are copyrighted for a period of 100 years after first publication.
  • Recordings that were first published between 1947 and 1956 are copyrighted for a period of 110 years after first publication.
  • Recordings that were published after 1956 and first fixed prior to February 15, 1972 will enter the public domain on February 15, 2067.

Note that sound recordings that were first fixed prior to February 15, 1972 are a special case under US copyright law and are not subject to the same formalities as other works. In particular, the terms of protection given above for pre-1972 recordings apply regardless of whether a recording was published with a copyright notice, or whether a recording was registered with the US Copyright Office, or whether a recording's rights were renewed. Files bearing this tag may be deleted in the future, depending on the outcome of community discussions and new case law. If you are the rights holder of this sound recording and do not wish to have it hosted on Commons, please contact our designated agent.
